The operator of this website respects the fundamental constitutional right to the protection of personal data, according to which everyone has the right to disclose and use their personal data. The protection of the data provided by visitors to our website is of paramount importance to us. Ape Regina Kft. treats visitors' personal data confidentially, in accordance with the applicable legal provisions, ensures their security, takes the technical and organizational measures, and develops the procedural rules that are necessary to enforce the relevant legal provisions and other recommendations. Ape Regina Kft. treats all data provided to it through the use of the website with the same protection as if it had been made available to it in any other way. When developing the provisions of the Notice, the company took into particular account the provisions of Regulation 2016/679 of the European Parliament and of the Council (the "General Data Protection Regulation" or "GDPR"), Act CXII of 2011 on the right to informational self-determination and freedom of information ("Infotv."), Act V of 2013 on the Civil Code ("Ptk."), and Act XLVIII of 2008 on the basic conditions and certain limitations of economic advertising activity. Act („Grtv.”), Act CVIII of 2001 on certain issues of electronic commerce services and services related to the information society, and Act C of 2000 on accounting (regarding the issuance and preservation of documents), Act CXIX of 1995 on the processing of name and address data for the purpose of research and direct marketing, and the provisions of Act VI of 1998 on the promulgation of the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data, signed in Strasbourg on 28 January 1981, and the recommendations of the “ONLINE PRIVACY ALLIANCE”.

The Data Controller reserves the right to change this information at any time. The data controller is committed to protecting the personal data of its partners and users, considers it particularly important to respect the informational self-determination of its customers, treats personal data confidentially, does not disclose it to third parties and takes all security, technical and organizational measures that guarantee the security of the data.

Legal basis of data management, basic principles during data management of the site

According to Section 5(1)(a) of Act CXII of 2011 on the Right to Informational Self-Determination and Freedom of Information, the Data Controller processes data exclusively with the voluntary consent of the data subject and exclusively to the extent necessary for the use of the Data Controller's services. The data controller stores the data in a secure manner, proportionate to the purpose of the data processing, for the period necessary for the purpose of the data processing.

Visitors to the website data

The pages of the website can be visited without providing personal information. When visiting the website, aperegina.hu may record the users' IP address, the time of visit and the address of the page viewed - for technical reasons and for the purpose of creating statistics on user habits. In order to provide customized service, the service provider places a small data package, a so-called cookie, on the user's computer. By using the website, the user accepts that the service provider places a cookie on their computer. The service provider, as a technical collaborator, may ensure that during the visit to the website, third parties cooperating with the service provider, in particular Google Inc., store using cookies if the user has previously visited the service provider's website and may display an advertisement to the user based on this. The user can delete the cookie from his/her own computer or set his/her browser to prohibit the use of cookies. In addition, Google ensures that the user can disable the cookies placed by Google on the page for disabling advertisements displayed by Google (https://www.google.hu/privacy_ads.html). By prohibiting or deleting the use of cookies, the use of websites may become more inconvenient for the user. By registering, the visitor to the website also subscribes to the Data Controller's services or to the newsletter containing information related to them, which is sent periodically. During the subscription, the user must provide his/her name and real email address. The Data Controller uses this data only and exclusively for the purpose of sending the newsletter, does not connect it with any other data, does not use it for any other purpose, and does not forward it to a third party for data management purposes. You can unsubscribe from the newsletter at any time, and in the event of unsubscribing, the Data Controller will immediately and irretrievably delete the email address from its system.

GENERAL CONTRACT TERMS

The subject of these General Terms and Conditions (GTC) is the order conditions for the advance payment of a reservation to the Ape Regina restaurant via online card payment. The subject of the service is that the Service Provider provides the Customer with the opportunity to confirm their reservation in such a way that the Customer immediately pays the full or partial amount of the reservation to the restaurant using card payment, at their own discretion. The Service Provider validates this with an advance payment invoice issued to the provided email address. The above Data Protection Notice provides for the handling of the Customer's personal data.
By using the website, the Customer acknowledges the following:

Method of storing personal data, security of data processing

The data controller selects and operates the IT tools used to manage personal data during the provision of the service in such a way that the managed data:
– is accessible to those authorized to do so (availability);
– its authenticity and authentication are ensured (authenticity of data management);
– its unchangeability can be verified (data integrity);
– protected against unauthorized access (data confidentiality)
. The Data Controller ensures the security of data processing by implementing technical, organizational and organisational measures that provide a level of protection appropriate to the risks associated with data processing.
During data processing, the Data Controller maintains
– confidentiality: protects the information so that only those who are authorized to do so can access it;
– integrity: protects the accuracy and completeness of the information and the processing method;
– availability: ensures that when the authorized user needs it, he can actually access the desired information and that the related tools are available.

Access to data, rights of data subjects, legal remedies

The data subject may request information about the processing of his or her personal data, as well as request the correction or deletion of his or her personal data, with the exception of data processing prescribed by law.
At the request of the data subject, the Data Controller shall provide information about the data processed by him or her or by the processor he or she has commissioned, the purpose, legal basis, duration of the data processing, the name, address (registered office) of the data processor and its activities related to data processing, as well as who receives or has received the data and for what purpose. The data controller shall provide the information in writing and in a plain language as soon as possible after the request has been submitted, but no later than 30 days.
The data controller shall delete the personal data if its processing is unlawful, the data subject requests it, the purpose of the data processing has ceased, or the statutory period for storing the data has expired, or the court or the Data Protection Commissioner has ordered it.
The data controller shall notify the data subject and all those to whom the data was previously forwarded for the purpose of data processing of the correction and deletion. The notification may be omitted if this does not violate the legitimate interests of the data subject with regard to the purpose of the data processing.
The data subject may object to the processing of his or her personal data if the processing (transfer) of the personal data is necessary exclusively for the exercise of the rights or legitimate interests of the data controller or the data recipient, unless the data processing is ordered by law;
– the use or transfer of the personal data is for the purpose of direct marketing, public opinion polling or scientific research;
– otherwise the exercise of the right to object is permitted by law.
The data controller – with the simultaneous suspension of data processing – shall examine the objection within the shortest possible time from the submission of the application, but no later than 15 days, and shall inform the applicant of the result in writing. If the objection is justified, the data controller shall terminate the data processing – including further data collection and transmission – and block the data, and shall notify all those to whom the personal data affected by the objection were previously transmitted about the objection and the measures taken on the basis thereof, and who are obliged to take measures to enforce the right to object.
If the data subject does not agree with the decision made by the Data Controller, he or she may appeal to the court within 30 days of its notification.
A complaint regarding data processing may be lodged with the court or with the National Data Protection and Freedom of Information Authority:

Register

Purchase is subject to registration in all cases. Registration can be initiated by calling +36 30 779 7545. The Customer is obliged to provide the personal data requested by our colleagues (name, email address, phone number) and billing information in accordance with reality during registration. Unless the Customer has otherwise provided otherwise, Ape Regina may periodically send information about its services in the form of a newsletter to the provided electronic contact information. The Customer may unsubscribe from the newsletter address list at any time.

The purchase process

With the data provided during registration, the restaurant issues an advance invoice to the Customer, which is forwarded to the provided email address by sending a unique, online card payment link. By clicking on the link, the Customer arrives at a closed online interface filled with their personal data, where they can pay the previously agreed amount with their bank card. We will send a confirmation of the amount received – after it has been credited to the account – to the email address provided during registration within 24 hours.

Registration deletion

The Customer is entitled to have their registration deleted at any time by sending a message to the Service Provider's email address info@aperegina.hu. The Service Provider makes the deletion of the registration subject to proper identification and to the fact that the email regarding the deletion arrives from the email address provided to the Customer's account, so that it can be determined for sure that the deletion of the registration was initiated by the authorized person. The Customer's user data will be removed from the system immediately after deletion, however, this does not affect the preservation of data and documents related to orders already placed, and does not result in the deletion of this data. Once removed, there is no way to restore the data.

Right of withdrawal and order cancellation

In order to avoid abuse, our restaurant is unable to refund advances paid by bank card in the event of a complete cancellation of the reservation. An exception is the case if, for technical reasons, the advance payment cannot be deducted upon departure. (e.g. due to a late transfer, it has not yet been credited to our restaurant's account. In this case, the full balance must be paid upon departure.). If, for unexpected reasons, the reservation cannot be validated at the previously agreed time, the Customer is obliged to inform the restaurant of this at least 5 days prior to the date, and the restaurant will try to reschedule the reservation for another time by offering a new time. In the event of a change to the time indicated, the advance payment amount will be calculated for the new reservation time. In case of a full cancellation or a cancellation less than 5 days in advance, the advance payment paid by bank card is also the cancellation fee, so we are unable to refund it regardless of the payment method. Advance payments transferred from a bank card cannot be converted into cash, bank transfer or other payment instruments that replace cash. If the reservation is cancelled in agreement with the restaurant, but the payment for the reservation has already been paid, in the event of a complaint or claim regarding an order paid in advance by bank card, the refund of the payment for the ordered service will be made according to the rules of bank card payment.
